The 2010 season has opened with fair weather and a strong run of Chinook salmon. Many charter operators still have a few openings so if you haven’t booked yet, now is the time.  For guides and lodge owners, key issues from regulators continue to make the headlines.

Increased Enforcement by both ADF&G and NOAA

Both NMFS/NOAA and ADF&G Wildlife Troopers have stepped up their enforcement activity this year. Guides should expect more on-the-water safety inspections and dockside regulations checks. Here is a recount of a recent encounter by one guide:

“I was boarded by USCG on Monday at sea for a very thorough safety inspection, (they didn't care or give any consideration to my courtesy exam papers or Five Star Program decal),  looked at fish (halibut), went through all lockers, holds, coolers and any place that would hold a fish. They indicated to me that boardings would be increased this year and not just for safety but for halibut fishery violations.

Also I had a dockside visit from local NMFS enforcement agent yesterday to give me a heads up on increased NMFS enforcement this year directed toward charter activities. He was especially interested in charters that take out a lot of "friends" supposedly for no compensation. He said he had been instructed to concentrate on the charter industry this year.”

You can expect enforcement officials to take a strong stand on daily catch limits, deck hands setting the hook for clients, boat limits, and use of sport caught fish for lodge meals. Remember that enforcement officials can board your vessel at any time for safety and regulations inspections. Also note that enforcement officials have been conducting undercover sting operations. The key for all of us is to thoroughly know the rules/regulations and to follow them. If you have any questions you should contact ADF&G or NOAA enforcement. Fines could exceed $10,000 and include jail time. A quick call for clarifications could save you money, time and embarrassment.

Halibut Issues

  1. Moratorium Rules Change to Angler Endorsement Calculation – During its April meeting, the North Council voted to amend the angler endorsement calculation for LEP permits, (see our news flash, http://www.seagoalaska.org/newsletters/2010-04-08_special_email.html for details). During that meeting they agreed to notify guides of the revised calculations by June. On May 26, we received the following communication from NMFS:

“NOAA Fisheries will be sending notices this week to affected charter halibut permit applicants regarding the proposed changes to angler endorsements, per Council action in April 2010.  We will be sending notices only to those applicants who, according to the official record, would receive more than one charter halibut permit.

We have tried to make it clear in the notice that it is for information purposes only because we have not yet completed the rulemaking process for this regulatory amendment.  NOAA Fisheries would change the official record to make the proposed changes ONLY IF AND WHEN the final rule for the angler endorsement change is approved.  Operators will have an opportunity to challenge the angler endorsement changes and, if necessary, appeal the proposed changes at the time the final rule is approved and effective.  We suspect the notice may cause some confusion for some operators and we are expecting to get some phone calls about it.

We hope to publish the proposed rule for the angler endorsement change in June.  There will be a 30-day comment period for the proposed rule, and we will endeavor to follow up with a final rule as soon as possible for the Secretary's consideration.  The proposed and final rules will be published on our web site, and I'll try to let you know when that happens.”

  1. Limited Entry/Moratorium Leasing issue – A proposed change to disallow lease of LEP permits was developed by NMFS and is found here: http://www.fakr.noaa.gov/npfmc/current_issues/halibut_issues/MoratoriumLeasing410motion.pdf

      1. At issue is the possibility that non-transferrable permits may not be retired when the guide stops offering trips but rather continues to lease his permit to others.

      2. There may also be some issues around industry consolidation however it is unclear that this is a problem due to the 5 permit cap restriction.

SEAGO continues work on the Southeast Alaska Economic Recovery (SEAKER) Halibut Management Plan – In January, we announced a two part plan designed to address both short term 2010 issues and longer term initiatives designed to improve implementation of the catch sharing plan.  We recently gained support from congressional leaders and other stakeholders and positive momentum continues. Catch Sharing General information– In a recent communication, NMFS has indicated a potential revised implementation date of 2012 for this program.

The catch sharing plan, if implemented the way it is currently written will have a profound negative economic impact on communities throughout Southeast Alaska where we live and work. SEAGO Board members and management have conducted ongoing discussions with NPFMC representatives and it appears that there is very little motivation to change any details. While catch share plans are the stated tool for fisheries management being promoted nationally by NOAA, we believe that a “commercial fishing oriented management plan” does not fit well with our sport fishing business models.  As a result SEAGO believes the catch sharing plan can be improved to benefit of all involved and would like to see changes in the plan and additional fisheries management tools implemented. We have taken a pragmatic approach and developed recommendations for improvement here.
